Introduction to the Terms of Use Agreement:
Our online store welcomes you and informs you that below you will find the terms and conditions governing your use of this store and all the legal implications arising from your use of the store's services via this electronic platform. Any person's use of (Ushbah Store), whether as a consumer of the store's services or products or otherwise, constitutes their acceptance and consent, with full legal capacity, to all the articles and provisions of this agreement. This confirms your commitment to its terms and conditions. This agreement applies to all types of transactions between the user and the store, except for transactions related to personal status matters and transactions related to issuing deeds for real estate transactions. This agreement becomes effective and binding upon your acceptance and registration with (Ushbah Store), in accordance with Article 10 of the Saudi Electronic Transactions Law.
Article 1 - Introduction and Definitions:
The above preamble is an integral part of this agreement. Below you will find the meanings and definitions of the key terms used in this agreement:
1. (The store) This phrase refers to (herb store), and this definition includes all forms of (herb store) on the Internet, whether it is an electronic application, a website on the Internet, or a commercial store.
2. (User) This term refers to any consumer who purchases a product or service from the store through its online platform.
3. (The Agreement) This term refers to the terms and conditions of this Agreement, which govern and regulate the relationship between the parties to this Agreement.
Article Two - User's Legal Capacity:
1. The user acknowledges that he has the legal capacity, according to Sharia and regulations, to deal with the store, or that he is at least eighteen years old.
2. The user agrees that if he violates this article, he shall bear the consequences of this violation before third parties.
Article Three - Nature of the Obligation (Herb Shop):
1. The commitment of (Ushbah Store) towards consumers or users is to provide (the service or product).
2. (The Herb Store) may provide other services such as after-sales services or other related services, depending on the nature and type of (service or product) required by the user.
Article Four - Rules for Use of (Herb Store):
1. The user commits to using the electronic platform of (Ushbah Store) in accordance with public morals and regulations in force in the Kingdom of Saudi Arabia.
2. When purchasing a service or product (herb store), the user agrees not to use this service or product in a manner that violates public morals and the regulations in force in the Kingdom of Saudi Arabia.
Article Five - Accounts and Registration Obligations:
By applying for membership in (Ushbah Store) as a user, you agree to disclose specific information and choose a username and password to use when accessing (Ushbah Store) services. By doing so, you agree to:
1. You are responsible for maintaining the confidentiality of your account information and password, and you agree to immediately notify (Ushbah Store) of any unauthorized use of your account information with (Ushbah Store) or any other breach of your confidential information.
2. (The Herb Store) will not be responsible under any circumstances for any loss that may be incurred by you, directly or indirectly, morally or materially, as a result of the disclosure of username or password information.
3. You commit to using your account or membership with (Ushbah Store) yourself, as you are fully responsible for it. If someone else uses it, this is evidence that you have authorized them to use the store in your name and on your behalf.
4. You agree that when using (herb store) you will use it with all seriousness and credibility.
5. You agree to disclose true, correct, up-to-date, complete and lawful information about yourself as required during registration with (Ushbah Store) and you agree to update your data if it changes in reality or if the need arises.
6. (Ushbah Store) is committed to handling your personal information and contact details with complete confidentiality.
7. If it becomes apparent to (Ushbah Store) that you have disclosed information that is untrue, incorrect, outdated, incomplete, illegal, or in violation of the Terms of Use, (Ushbah Store) has the right to suspend, freeze, or cancel your membership, store, and account on the platform, without prejudice to (Ushbah Store)’s other rights and legitimate means of recovering its rights and protecting other users.
8. In the event of non-compliance with any of the above, the management of (Ushbah Store) has the right to suspend or cancel your store or membership or block you from accessing (Ushbah Store) services again.
Article Six - Electronic Communications and Official Means of Communication:
1. The parties to this agreement agree that communication will be via the email address registered on the platform.
2. The user agrees that all agreements, declarations, statements and other communications provided electronically are equivalent to their written counterparts and constitute a valid and self-sufficient argument in meeting regulatory and legal requirements.
3. The user agrees to be contacted and notified of any provisions relating to this agreement or to dealing with him through the (Herb Store) administration broadcasting general messages that are sent to all users or to specific users of (Herb Store).
Article Seven - Amendments to the User Agreement and Fees:
1. (The Herb Store) may inform you of any amendment to this agreement in accordance with the official communication channels under this agreement, and accordingly your obligations will increase or your rights will decrease in accordance with any amendments that may be made to this agreement.
2. In case of objection to any amendment to the Terms of Use, (Ushbah Store) hopes that you will stop using its services, as your access to your account in (Ushbah Store) or your use of (Ushbah Store) is considered your acceptance of the amendments and full and complete agreement without ignorance, and (Ushbah Store) accepts discussion of any suggestion regarding these terms.
3. All fees are calculated in Saudi Riyals, and the user must pay all fees due on the platform plus any other expenses added by (Ushbah Store), provided that payment is made through the approved, specified and available methods through (Ushbah Store).
4. (The Herb Store) may charge some users fees depending on the offers, products or services they request, or on the fees or taxes imposed by the state on the nature of the product or service.
5. (Ushbah Store) reserves the right to add, increase, decrease, or deduct any fees or expenses under the terms and conditions of the User Agreement, from any user, regardless of the reason for their registration.
Article Eight – Payment and Settlement Services for Stores in (Ushbah Store):
1. (Ushbah Store) provides, through its partners, a payment and settlement system in (Ushbah Store). Payment can be made entirely online through the payment options available on (Ushbah Store) or through any payment method provided by (Ushbah Store) from time to time.
2. (Ushbah Store) is committed to setting the price of the service or product it offers in its store according to the commonly accepted market value.
3. (Ushbah Store) is committed to providing invoices, receipts and delivery notes for all amounts and profits generated in its store, and is committed to giving the user an invoice for their purchase of a service or product (Ushbah Store).
4. (Ushbah Store) is committed to providing the accounting specifications commonly accepted in its online store, in accordance with the provisions of this agreement, and in light of the legal, economic, commercial and regulatory interests in this arrangement.
Article Nine - Your personal information and transaction details:
1. The user acknowledges granting (Ushbah Store) an unlimited, worldwide, perpetual, irrevocable, royalty-free, and transferable right to use any personal or other information or materials provided or supplied to the (Ushbah Store) platform, or published on the platform through the user's registration or use of the platform, via the designated communication and registration forms, or via any email or other communication channels available on the platform. This is for the purpose of achieving any interests deemed appropriate by the platform.
2. The provisions regarding the confidentiality of consumer information are subject to the rules of the “Privacy and Confidentiality Policy” of (Ushbah Store), and to the provisions in this agreement relating to confidentiality of information.
Article Ten – Intellectual Property:
1. The intellectual property rights of (Ushbah Store) are fully owned by (Ushbah Store), whether they were owned by them before or after the establishment of this electronic platform.
2. The user or consumer respects the intellectual property rights of (Ushbah Store), which include (Ushbah Store) itself, and the words, logos and other symbols belonging to (Ushbah Store) or displayed on (Ushbah Store), as (Ushbah Store), and every right that follows in (Ushbah Store), are fully intellectual property rights owned by (Ushbah Store).
Article Eleven - Liability of (Herb Shop):
1. (Ushbah Store) is committed to conducting its business through this electronic platform in a regular manner and in accordance with the regulations in force in the Kingdom of Saudi Arabia, and in accordance with the provisions of this agreement.
2. (The Herb Store) does not bear any claims arising from errors or negligence, whether caused directly, indirectly, incidentally, by the user, or by a third party such as shipping companies.
3. (Ushbah Store), its employees, owners, and those who represent them are committed to ensuring that the (product or service) is sound, legitimate, and authorized in accordance with the laws and regulations of the Kingdom of Saudi Arabia and is used for legitimate purposes.
Article Twelve – Confidentiality of Information:
1. (The Herb Store) adopts (tangible, organizational and technical) standards to protect users and prevent unauthorized access to and storage of users’ personal information.
2. As a user, you acknowledge that the internet is not a completely secure medium, and the confidentiality of your personal information cannot be 100% guaranteed through (Ushbah Store).
3. (The Herb Store) has no control over the actions of any third party, or third parties, such as other web pages linked to the platform or third parties claiming to represent you and others.
4. You know and agree that (Ushbah Store) may use the information you have provided to it, for the purpose of providing services to you at (Ushbah Store), and to send you marketing messages, and that privacy at (Ushbah Store) controls the collection, processing, use and transfer of your personal identity information, and the rules of confidentiality of information are subject to the “Privacy and Confidentiality Policy” of (Ushbah Store).
Article Thirteen - Restriction of Access or Membership:
(The Herb Store) may suspend or cancel a user’s membership or restrict a user’s access to the platform’s services at any time, without notice, for any reason, and without limitation.
Article Fourteen – Replacement Policy:
1. Without prejudice to the provisions of the contractual and statutory warranty, the consumer has the right to exchange the product provided to him by (Ushbah Store) within the seven days following the date of receiving the product, and he does not have the right to exchange the product after the seven days have passed.
2. The replacement of the product requires that the product be in good condition and that the consumer has not used the product or obtained its benefit. (Ushbah Store) has the right to inspect the product before replacing it to ensure its safety.
3. The consumer is not entitled to exchange the product in the following cases:
• If the product was manufactured based on the consumer’s request or according to specifications he specified, excluding products that are defective or that do not conform to the specifications specified by the consumer.
• If the product consists of videotapes, discs, CDs, or software that have been used.
• If the product is newspapers, magazines, publications, books, or anything else that is considered a publication.
• If a defect appears in the product due to the consumer's misuse.
• If the contract involves providing accommodation, transportation, or catering services.
• If the contract involves purchasing software download products online.
Article Fifteen – Return Policy:
1. Without prejudice to the provisions of the contractual and statutory warranty, the consumer has the right to cancel the contract and return the product provided to him from (Ushbah Store) within the seven days following the date of receiving the product, and he does not have the right to that product after the seven days have passed.
2. The return of the product is conditional on the product being in good condition and the consumer not having used the product or obtained its benefit. (Ushbah Store) has the right to inspect the product before returning it to ensure its safety.
3. The consumer is not entitled to return the product in the following cases:
• If the product was manufactured based on the consumer’s request or according to specifications he specified, excluding products that are defective or that do not conform to the specifications specified by the consumer.
• If the product consists of videotapes, discs, CDs, or software that have been used.
• If the product is newspapers, magazines, publications, books, or anything else that is considered a publication.
• If a defect appears in the product due to the consumer's misuse.
• If the contract involves providing accommodation, transportation, or catering services.
• If the contract involves purchasing software download products online.
4. If the provisions of the aforementioned return policy are met, the consumer has the right to cancel the contract and return the product to (Ushbah Store) with a refund of the amount paid.
Article Sixteen - Applicable Law or Regulation:
This User Agreement is governed by and construed in accordance with the laws, regulations and legislation in force in the Kingdom of Saudi Arabia, and is subject in full and completely to the regulations in force with the authorities in the Kingdom of Saudi Arabia.
Article Seventeen - General Provisions:
· In the event that any article or clause contained in this User Agreement is cancelled or that any article or clause contained in this User Agreement is no longer valid, such matter shall not invalidate the validity of the remaining articles, clauses and terms contained in this User Agreement and shall remain in force until further notice from the management of (Ushbah Store).
This User Agreement - which may be amended from time to time as necessary - constitutes the User Agreement, operating mechanism, understanding, agreement, and contract between (Ushbah Store) and the user. Both parties to this agreement agree that the following shall be taken into consideration:
1. Arabic shall be the language used when interpreting the provisions of this Agreement, or when translating it into another language.
2. All prices displayed for services or products (herb store) may be modified from time to time.
3. The promotional or marketing offers that may be put forward by (Ushbah Store) are temporary offers, as (Ushbah Store) has the right to modify or discontinue these promotional or marketing offers at any time.
4. The parties to this agreement commit to dealing with each other in a manner that does not violate the Sharia rules, regulations, and applicable laws related to the nature of the transaction between (Ushbah Store) and the user.
5. This User Agreement shall not be cancelled except by a decision issued by the management of (Ushbah Store).
